Fort Smith Concrete & Masonry is a masonry contractor providing services including, but not limited to: foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, fireplace installation, stone veneer installation, concrete block walls, and related masonry and concrete work.
We serve residential and commercial customers in Fort Smith, AR and surrounding communities. The availability of specific services and the geographic area we serve may change without notice.
All estimates provided by Fort Smith Concrete & Masonry are based on information available at the time of the site visit or consultation. Written estimates are valid for 30 days from the date issued unless otherwise stated.
An estimate is not a guaranteed final price. Final pricing may vary if:
Any significant change in scope or cost will be communicated to the customer before additional work proceeds.
Scheduling is subject to availability. We will make reasonable efforts to honor agreed start dates, but delays may occur due to weather, material availability, or other circumstances beyond our control.
If you need to reschedule or cancel a scheduled job, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice may result in a fee to cover any preparatory costs already incurred, including material orders or equipment staging.
We reserve the right to reschedule jobs due to weather conditions that would compromise the quality of the work, such as rain, freezing temperatures, or extreme heat. We will notify you as soon as practicable if a weather delay is necessary.
Payment terms will be specified in your written estimate or project agreement. Standard terms require a deposit prior to the start of work, with the remaining balance due upon completion, unless otherwise agreed in writing.
We accept payment by cash, check, or other methods specified at the time of your estimate. Returned checks are subject to a returned check fee.
Invoices not paid within 30 days of the due date may accrue interest at the maximum rate permitted by Arkansas law. In the event collection action is required, the customer agrees to pay reasonable attorneys' fees and collection costs.
Work will not begin until a deposit has been received where required. Final walkthroughs will be conducted prior to final payment. Full payment constitutes acceptance of the completed work.
For projects that require a building permit under City of Fort Smith or applicable municipal codes, Fort Smith Concrete & Masonry will obtain the required permits prior to commencing structural work. Permit fees are the responsibility of the customer and will be included in the project estimate.
The customer is responsible for ensuring that the property is free of known underground utilities, easements, or other restrictions that may affect the work. Fort Smith Concrete & Masonry is not liable for damage to unmarked or undisclosed utilities or structures.
Fort Smith Concrete & Masonry warrants that all work will be performed in a professional and workmanlike manner, consistent with industry standards for masonry and concrete work in Arkansas.
Specific warranty terms, including duration and coverage, will be provided in writing with your project agreement. Warranty coverage generally applies to the repair method and installation performed by our crew. It does not cover:
Any warranty claims must be submitted in writing to support@masonryfortsmith.com within the warranty period. We will evaluate the claim and respond within a reasonable timeframe.
To the maximum extent permitted by applicable law, Fort Smith Concrete & Masonry shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to our services or your use of our website.
Our total liability for any claim related to a specific project shall not exceed the total amount paid by the customer for that project. This limitation applies regardless of the form of the claim, whether in contract, tort, or otherwise.
Our website and any information on it is provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

If the dispute cannot be resolved informally, the parties agree to attempt to resolve it through non-binding mediation before pursuing litigation. The cost of mediation shall be shared equally.
Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction to protect their rights pending resolution.
These Terms and Conditions are governed by the laws of the State of Arkansas, without regard to its conflict of law provisions. Any legal action arising out of or related to these terms or our services shall be brought in the state or federal courts located in Fort Smith, AR, and you consent to the personal jurisdiction of those courts.
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective when posted on our website with an updated effective date. Your continued use of our website or services after any changes constitutes your acceptance of the updated terms.
